Radio Show with Ruben Treviso about Veteran’s Dialysis issues

Ruben Treviso has been an energetic fighter for veterans ever since he came back from Vietnam in 1971. He’s been involved in numerous projects in Greater L.A. to honor vets in recent years.

Ruben is a TV host on El Monte TV3 dealing with Veteran’s concerns. He recently interviewed Arlene and Bill Tinker founders of Dialysis Advocates along with Reverend Robert Hoyt one of the many Dialysis Patient’s they have helped.

Reverend Hoyt, a Veteran, had been wrongly terminated from Dialysis care after questioning his level of care. He along with Arlene and Bill told viewers of the many abuses taking place in some clinics.

Treviso has become involved with the problems in Dialysis Care and is bringing this to the attention of the many contacts he has in Washington.

Dialysis Patients being discharged with no appeal, no assistance from CMS & ESRD

Dr. Conway,

I have tried to reach you in the past. It appears that there is a trend, that has been going on for years. It has been allowing dialysis units to discharge patients for no cause, even with creative paperwork to discharge the patient unfairly. Then when a patient is discharged the patient is blackballed at any other clinic, denying them entrance. A patient is denied a transplant and used as a payback, by labeling them non-compliant…without the patients knowledge..It is a nightmare to be a patient on dialysis.

CMS promised me that they were not going to allow anymore discharges of patients unless they are violent. These Nephrologists are now dismissing them, because they can. I am getting a record number of discharges myself.

I have one currently in Nashville and have contacted CMS at the highest levels. This patient was dismissed from a Nephrologist from Vanderbilt Medical University, a co-director of Nephrology Clinical trials. Which receives Federal dollars. He is partners with Davita.

These are just some of the discharged patients that are recent, with CMS sitting on their hands. I will not insult you with the fact that the ESRD Networks are the main players in these discharges and provide the legal way to “dump” a patient. I thought they were for quality of care of the patients.

Patients speaking out on care are fearful of retaliation.

Patients discharged have no appeal process and die. CMS has been contacted on every discharge and has sat by and did nothing.

Patients are not allowed to see their charts in many clinic…

This industry has been allowed to do pretty much as it pleases, CMS standing by silent. This is not about healthcare and the money for patient care is going to industry “bonuses”.

I am seeking help for patients getting quality of care and to have rights in these clinics. I have done thousands of complaints, with no help from CMS. It is about time to ensure patients have rights with qualified workers. It is getting where my caseload with discharged patients and abusive practices are on the rise.

Another trend is that we have had patients have full fledged strokes in clinics and the staff will not call 911, but will call the family. Infection control is another area that is costing lives and medicare money. They simply have them go to the ER for care and they are infection free.

Prayers Were Answered

Thank you everyone for your prayers and support for Thomas in Nashville, he is now accepted in a Vanderbilt clinic. It appears that they had a change of heart, or was it the threat of involving the ALCU? It was a close call that he didn’t die, but he is not doing well…hopefully this will end this insanity. Someone needs to be held accountable.

Again, thank you for your prayers and Thomas appreciates every one. This young man will be able to live, but what about the patients we know nothing of their discharges and inhumane treatment.

He is in the ICU at Vanderbilt. It does not look good.

I don’t know how Dr. Schulman, Vanderbilt, CMS and Davita can sleep at night. Including the ESRD Network which is your oversight for Quality of care, signs off on dismissals. Our tax dollars working against you.

To release Thomas was a death sentence and all the clinics nearby that denied him care also need to be ashamed…if they are even capable of any empathy.

CMS has been aware and has once again, will allow this patient to die.

It will not be hidden any longer. We are mobilizing this demonstration and patients, this could’ve been you. If not you, who will fight for you if you won’t even fight for yourselves. You have an opportunity now with the marches. Dont expect someone else to do it. Be supportive of the marches and those who care that you have rights.

What do I tell discharge patients, do a crime and you will get dialyze as a prisoner. But, if you’re discharged in this country the industry puts up every road block to ensure you die. With CMS allowing it.

Being poor is his crime and with no right of appeal, you die..

Shame on us as a Nation…patients you need to step up to the plate. I have handled many, many discharges and all you have to do in some cases is complain about care.

It appears that one of our Texas patients is being denied care. His Creatinine is out of limits and are refusing once again to give him dialysis

This is the 3rd blind patient that has been discharged as threats. We have tapes of conversations with the ESRD Networks helping to support a dismissal…..our tax dollars at work.

I am pasting an email to Kent Thiry and CMS…..this Physician I will post his name and see if we can get the recordings of conversations. Hannibal Lector has a better reference.

It appears that a patient in Lewisville Tx has been discharged for going to his doctors office to complain about his personal protected information being told were all patients can hear. The Secretary had started yelling at him and told him to go and wait in the waiting room. She called the police and he was discharged immediately, as she was afraid of a blind man that is 6’1 and weighs 120 lbs. He has cancer. 

Davita had discharged him immediately, as the Medical Director had. It appears that one Physician was going to take him, until he talked to Dr. Baker….Hannibal Lector has a better reference. Many rejections and this is so unfair. Were is due justice? Several Rn’s and Social workers have told him to record conversations. They are very interesting, even from the ESRD Networks.

It appears that I have shown you many cases of Davita’s discharges. This is one of the unfairest that I have seen. He has been refused by hospitals in the area. They use the K as the qualifier and his Creatinine is extremely high. It appears that no Nephrologist is seeing him. 

The other blind impared patient has been discharged in New York with no where to dialize…His crime also was manufactured. 

I have several Texas patients and one is being harassed. He also is blind.

I dont expect anything out of you, as all other emails have been avoided. Out of sight out of mind. I do expect the one patient in Texas to die, as he is being denied care.

If you want the HIPPA form, I will release the information. Shame on you Kent! Shame on you CMMS
